These Terms of Service (“Terms”) govern your access to and use of x-sensory.com (the “Site”) and any purchase you make from us. By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.
1. Adults only (18+)
X-Sensory sells intimate-wellness and adult products intended for personal use by adults. You may only use the Site and purchase from us if you are at least 18 years old, or the age of majority in your jurisdiction if that age is higher. By using the Site or placing an order, you represent and warrant that you meet this requirement. We use age-verification measures and may refuse or cancel any order where age cannot be confirmed.
2. The products
Our products are intimate-wellness and pleasure devices and related accessories. They are consumer products for personal, lawful use. They are not medical devices. Nothing on the Site is intended to diagnose, treat, cure, or prevent any condition, and nothing we publish is medical advice. Always follow the manufacturer's instructions, and consult a licensed healthcare professional about any health concern.
3. Eligibility and lawful use
You agree to use the Site and any product only where it is legal to do so, and you are responsible for compliance with the laws of your own jurisdiction, including any local restrictions on the sale, import, or possession of adult products. You may not purchase for resale unless you have a written wholesale agreement with us.
4. Orders, pricing, and acceptance
All orders are offers to purchase and are subject to our acceptance. We may decline or cancel any order for any lawful reason, including suspected fraud, pricing errors, stock limits, or inability to verify age. Prices, availability, and product details may change without notice. Where a price is listed in error, we may cancel the order even after it is placed and will refund any amount charged.
5. Payment
Payment is processed by third-party payment providers. By submitting an order you authorize us and our providers to charge your payment method for the order total, including taxes and shipping. We do not store full card numbers. Your purchase may also be subject to the terms of the applicable payment provider. Charges appear under a discreet billing descriptor.
6. Taxes
Prices exclude applicable sales, use, or similar taxes unless stated. We collect and remit tax where we are required to do so. You are responsible for any taxes, duties, or import fees imposed by your jurisdiction that are not collected at checkout.
7. Shipping and risk of loss
We ship in plain, unbranded packaging. Estimated delivery windows are estimates, not guarantees. Title and risk of loss pass to you on delivery to the carrier, except where law provides otherwise. We are not responsible for carrier delays. You are responsible for providing an accurate, complete delivery address.
8. Returns and refunds
For hygiene and safety reasons, opened or used intimate products cannot be returned or exchanged. Our full policy, including the limited circumstances in which returns are accepted, is set out in our Returns & Refunds Policy, which forms part of these Terms.
9. Acceptable use
You agree not to: use the Site if you are under 18; provide false information, including about your age; use the Site for any unlawful purpose; resell our products without authorization; interfere with the Site's operation or security; or infringe our or any third party's rights.
10. Intellectual property
The Site, including its design, text, graphics, logos, and the X-Sensory marks, is owned by XSensory LLC or its licensors and is protected by intellectual property laws. You may not copy, reproduce, or use any of it without our prior written permission. Product names and marks of manufacturers we carry belong to their respective owners.
11. Disclaimers
The Site and products are provided “as is” and “as available” to the fullest extent permitted by law. We disclaim all warranties not expressly stated, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Manufacturer warranties, where offered, are provided by the manufacturer and not by us.
12. Limitation of liability
To the fullest extent permitted by law, XSensory LLC and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Site or any product. Our total liability for any claim relating to the Site or a product will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some may not apply to you.
13. Indemnification
You agree to indemnify and hold harmless XSensory LLC from any claim or demand, including reasonable legal fees, arising from your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right.
14. Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. Any dispute relating to these Terms or to your use of the Site will be brought exclusively in the state or federal courts located in Wyoming, and you consent to the jurisdiction of those courts.
15. Changes
We may update these Terms from time to time. The “Effective date” above shows the latest revision. Continued use of the Site after changes means you accept the revised Terms.
